Welcome to BreakReturns. By accessing or using our website, mobile application, and services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using BreakReturns, you agree to these Terms, our Privacy Policy, and any additional terms that may apply. If you do not agree, do not use our services.

2. Eligibility

You must be at least 18 years old to use BreakReturns. By using our services, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. How BreakReturns Works

Shares: Users purchase shares in sports card breaks. Each break is divided into 10 equal shares. Purchasing shares entitles you to participate in the silent auction for cards pulled in that break and receive a proportional share of auction proceeds.

Silent Auctions: After a break, each card is auctioned to shareholders. Each shareholder may place one sealed bid per card. The highest bidder wins the card. All bids are final and binding.

Payouts: Auction proceeds are distributed proportionally to all shareholders based on their share count. Payouts are credited to your wallet balance and can be withdrawn via PayPal.

5. Purchases and Payments

• All share purchases are final and non-refundable once a break has started
• Prices are in US Dollars
• Payment processing is handled by PayPal
• You are responsible for any applicable taxes

6. Auction Rules

• Only shareholders may bid on cards from their break
• Each user may place only ONE bid per card
• Bids cannot be modified or withdrawn once placed
• Highest bidder wins; ties are resolved by earliest bid timestamp
• Winning bidders must pay within 24 hours or forfeit the card
• Bid amounts must meet or exceed the starting bid

7. Shipping

Cards won at auction will be shipped to the address you provide. Shipping costs are the responsibility of the buyer. We are not responsible for packages lost or damaged by carriers after shipment.

8. Wallet and Withdrawals

• Auction payouts and refunds are credited to your wallet
• Wallet balance can be used for future purchases or withdrawn
• Withdrawals are processed via PayPal within 1-3 business days
• Minimum withdrawal amount may apply

9. Prohibited Conduct

You agree not to:

• Violate any laws or regulations
• Create multiple accounts
• Manipulate auctions or collude with other users
• Use bots or automated systems
• Harass or abuse other users or staff
• Attempt to circumvent security measures
• Misrepresent your identity or affiliation

10. Card Authenticity and Condition

All cards sold through BreakReturns are genuine. Cards are shipped in the condition they were pulled from sealed products. We do not grade cards unless specifically stated. Minor imperfections from manufacturing are not grounds for refund.

11. Disclaimer of Warranties

BreakReturns is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, error-free operation, or specific outcomes from your participation.

12. Limitation of Liability

To the maximum extent permitted by law, BreakReturns shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services.

13. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.

14. Account Termination

We may suspend or terminate your account for violation of these Terms. Upon termination, your right to use the service ceases immediately. Wallet balances for terminated accounts due to fraud will be forfeited.

15. Changes to Terms

We may modify these Terms at any time. Continued use after changes constitutes acceptance of the new Terms. Material changes will be communicated via email or platform notification.
